Tenants will be able to register contracts with the Finance Department from 1st August. The diploma that will allow tenants to register the lease contract on the Finance Portal, if the landlord has not fulfilled this obligation, was published last Thursday, March 13, and the measure will come into effect from August 1, 2025.
Under current legislation, the obligation to register contracts with Finanças falls upon the property owner. However, it has been found that, for various reasons, the contract is not always duly registered, which prevents tenants from deducting rent from their IRS or automatically accessing support measures, such as rent support.
According to the ordinance published last Thursday and signed by the Secretary of State for Tax Affairs, Cláudia Reis Duarte, this measure allows tenants or subtenants to communicate to Finanças new contracts, alterations or terminations of leases and subleases, whenever the landlords or subtenants do not fulfill their registration obligation.
Registration must be done electronically using the specific form which will become available for the purpose on the Finanças website, the format of which is included in the ordinance.
